Terms of Service

1. Service Description

Lean Obsidian Studio ("the Service") is a web application that generates configuration files for Obsidian - including Bases (.base), CSS Snippets (.css), and Templates (.md) - using AI. The Service is operated by Sascha D. Kasper, Romania.

2. Account Registration

You must create an account to use the Service. You are responsible for keeping your login credentials confidential. Each person may hold one account. You must provide a valid email address.

By creating an account, you confirm that you have read our Privacy Policy and agree to these Terms.

3. Subscription Tiers and Limits

Generation limits reset daily at midnight UTC. Paid subscriptions are billed through Stripe. Prices are in US dollars and may be subject to applicable taxes.

4. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving any reason (OUG 34/2014 Art. 9, implementing EU Directive 2011/83/EU).

To exercise this right, send a clear statement (e.g. by email to lp@sascha-kasper.com) before the withdrawal period expires. Upon valid withdrawal, we will refund all payments received from you within 14 days.

Exception: If you have used AI generation during the withdrawal period and explicitly consented to immediate service delivery at checkout, you acknowledge that the right of withdrawal may be reduced proportionally to the services already provided (OUG 34/2014 Art. 16(m)).

5. Generated Output

All output generated by the Service (YAML, CSS, and Markdown files) belongs to you. You may use, modify, and distribute it freely in your Obsidian vaults and elsewhere without restriction or attribution.

AI-generated output may contain errors or suboptimal configurations. You are responsible for reviewing output before using it in your vault.

6. Acceptable Use

You agree not to:

• Attempt to bypass rate limits or authentication mechanisms
• Use the Service to generate harmful, illegal, or abusive content
• Reverse-engineer, scrape, or systematically extract data from the Service
• Share your account credentials with others or operate multiple accounts
• Use automated tools to access the Service beyond its intended interface

Violation of these rules may result in account suspension or termination.

7. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

8. Liability

Our liability is governed by Romanian law (New Civil Code, Art. 1349-1395). In particular:

• We are liable without limitation for damages caused by willful intent or gross negligence.
• We are liable without limitation for injury to life, body, or health.
• For ordinary negligence, our liability is limited to foreseeable, contract-typical damage. For paid users, this is capped at the fees you have paid in the 12 months preceding the claim.

This does not affect your mandatory consumer protection rights under Romanian or EU law.

9. Cancellation

You may cancel your paid subscription at any time through the "Manage Subscription" option in the app. Access continues until the end of the current billing period. After cancellation, your account reverts to the free Explorer tier.

10. Account Deletion

You may permanently delete your account at any time using "Delete Account" in the app menu. Deletion removes your profile, usage history, and cancels any active Stripe subscription. See our Privacy Policy for details on what data may be retained by third parties after deletion.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer in the EU, you also benefit from mandatory consumer protections under the laws of your country of residence. Nothing in these Terms limits those rights.

For consumers, the courts at your place of residence have jurisdiction. For business users, the exclusive place of jurisdiction is Bucharest, Romania.

12. Changes to These Terms

We may update these Terms. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to updated Terms, you may delete your account before the effective date.
